Gendis Product Warranty

We, General Distribution Limited of Paxton House, Home Farm Road, Brighton, East Sussex, BN1 9HU (“Gendis”), are delighted to announce that the warranty on our products is two (2) years from the date of manufacture. 

  1. Details of the warranty 

    1. Gendis warrants that all the products in all current product lines made by Gendis will conform to their specification and be of satisfactory quality for a period of two (2) years from the date that the particular product is manufactured (the “Warranty”). 

    2. Save as expressly set out in this document, all conditions, warranties, representations and other terms which might otherwise apply in respect of Gendis’ products, either expressly or by implication, whether by statute, common law or otherwise, are hereby excluded.

  2. Conditions 

    1. Unless Gendis agrees otherwise in writing, the Warranty is subject to the product being returned in suitable packaging to Gendis at the above address at the customer’s cost and within a reasonable time of discovery that the product does not comply with the Warranty for testing. 

    2. A note must be enclosed explaining the fault and giving a name, address and telephone number of the purchaser or a person within the purchaser’s organisation who can explain the fault found with the equipment.

  3. Remedies

    1. In the event that a claim is made for breach of the Warranty which Gendis considers (acting reasonably) to be valid, Gendis will (at its option) repair, replace or recondition the relevant product as soon as reasonably practicable or refund the purchase price paid by the claimant for the product (either by providing credit or cash). The foregoing is the purchaser’s exclusive remedy for breach of the Warranty.

    2. Any repaired, replaced or reconditioned product shall continue to be subject to the Warranty for the unexpired term of the original two (2) year period from the date of manufacture.

  4. Exclusions

    1. Gendis shall have no liability or responsibility (whether under the Warranty or otherwise) in respect of any failure of a product to comply with the Warranty in any of the following events:

      • the product continues to be used after Gendis is notified of the Warranty claim;

      • the defect arises because of a failure to follow Gendis’ oral or written instructions as to the storage, commissioning, installation, use and maintenance of the product or (if there are none) good trade practice regarding the same;

      • the defect arises as a result of Gendis following any drawing, design or specification supplied by the customer;

      • any alteration or repair to the product without the written consent of Gendis;

      • the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal storage or working conditions, including, without limitation, use in excess of the product’s maximum number of operations, inappropriate electrical loading and damage from fire or lightning; or

      • the failure is the result of changes made to ensure the product complies with applicable statutory or regulatory requirements.

  5. Limits on Gendis' liability 

    1. Subject to clause 5.2 below, Gendis’ maximum liability under the Warranty and/or in connection with the product shall not exceed the amount paid by the purchaser for that product and Gendis shall not be liable for loss of business, loss of use, loss of profit, loss of anticipated profit, loss of contracts, loss of revenues, loss or damage to goodwill or brand, loss of anticipated savings, loss of data or use of data, product recall costs, damage to reputation, and/or any consequential, special or indirect loss or damage. 

    2. Gendis does not seek to limit or exclude in any way its liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, in respect of any breach of any condition implied under section 12 of the Sale of Goods Act 1979, and/or for any other matter or liability which cannot be lawfully limited or excluded including, without limitation, where the purchaser is a consumer (as opposed to a trade or business purchaser) any rights statutory rights which the purchaser is entitled to as a consumer.
